Types of leave application

Types of Leave Applications 

  • Sick Leave  

Sick leave is basically a leave of absence due to an illness. Sick leave is granted under a number of scenarios; for personal physical or mental illness, the care of a sick child, spouse, parent, or parent of a spouse, regular health checks, and/or to address the physical, psychological, and legal effects of domestic abuse. 

At the moment, there are no federal legal requirements for paid sick leave. For companies subject to the Family and Medical Leave Act (FMLA), the Act does require unpaid sick leave. The U.S. government ensures that federal employees get 13 paid sick days a year.

  • Study Leave 

Study leave is basically a leave of absence from work granted in order to allow a person time to study or carry out research. In the case of a school pupil, it allows them to study at home, usually in order to prepare for examinations.

According to the labor laws in the US, Study Leave with or without pay is a matter for arrangement entirely between the employer and the employee. By law, the maximum length of study leave granted in the same employer’s service is two years. 

  • Sabbatical 

By definition, a Sabbatical leave is a period in which a person does not report to his regular job but who remains employed with that company. Also commonly referred to as ‘career break’ or ‘adult gap year’, It is a period away from work, agreed with your employer.

The truth is, there are no laws that cover taking a career break or sabbatical; as such employees have no statutory right to take leave. A sabbatical will in most cases be an authorized, unpaid leave of absence.

  • Maternity/Paternity Leave

Maternity leave is basically a period of absence from work that is granted to a mother before and after the birth of her child. The US government doesn’t guarantee for paid maternity leave, employers may, however, provide paid leave if they choose. If you have worked at a company for at least a year, you are entitled by federal law to take up to 12 weeks of unpaid maternity leave.

Paternity leave is a period of time that the father of a new baby is allowed away from work. Usually, a company provides up to eight weeks of paid paternity leave. When a man takes time off because his partner is having a baby, adopting a child or having a baby through a surrogacy arrangement he might be eligible for: 1 or 2 weeks’ paid paternity leave, paternity pay and/or shared parental leave and pay.

  • Vacation/Holiday Request Letter 

Vacation leave is ideally available to all eligible employees for the purpose of rest, relaxation, and to attend to personal affairs. In this post, I’ll cover:

Before you submit the leave application

This is common sense, but some, especially when it comes to short leave, just apply for leave without talking to their manager.

A sudden application without first warming him about the plan may not just hurt his ego (‘why didn’t he ask me first?’), but also convey lack of seriousness of the reason for which you’re seeking leave.

The longer the intended leave, the earlier you should initiate the discussion. For example, if you’re planning a two-week leave, talk to your manager about it a month in advance. In contrast, if you’re seeking a casual leave for just a day or two, you may speak to him a day or two before proceeding on leave.

You should ideally speak to him at a time when he is not hassled by work and is not in foul mood. A good time, for example, could be toward the end of the day during coffee or other break.

Remember, an email or phone call is not a replacement for this conversation. Email or phone call may convey taking the boss for granted even if you don’t mean to. (However, phone call may be the only option if you’ve to apply for a leave in emergency.)

A sabbatical leave is the kind where you (for a given period) stop reporting to work for an extended period of time but you are still an employee of that company. Another name for it is “adult gap year” or “career break”. It’s highly likely to be an unpaid leave of absence.

There are no laws that cover you if you want to take a career break. This may be the most delicate application to write.

Options if you need a medical certificate for sick or carer's leave

Many workplaces require documentation for sick and carer's leave but with the rising price of GP consultations, getting one can be an expensive and time-consuming exercise.

So what options are available and what are the most cost-effective choices?

Know whether you need one

Shae McCrystal, a Professor of Labour Law at the University of Sydney Law School, specialises in employees' rights and responsibilities and advises workers to make sure they are familiar with their enterprise agreements and industrial awards.

"Medical evidence is not always required [for personal leave], so it's a good idea, just in general, really, for employees to have some familiarity with the industrial instrument that applies to their workplace.

"It will have this kind of information in it and lots of employers will also have the relevant information on their websites and in their policy documents."

Visiting a doctor

The most cost-effective method of obtaining documentation for sick or carer's leave is by visiting a fully bulk-billing doctor for a free consultation and certificate.

That's often easier said than done, with new data showing there has been a drop in medical clinics that bulk bill adults without concession cards in 87 per cent of electorates across Australia .

The Australian Medical Association recommends clinics charge $102 for consultations lasting between six and 20 minutes and although Medicare cardholders are entitled to a $41.20 rebate , this is still likely to leave a patient about $60 out of pocket for documentation for a day off.

Medical certificates cannot be "backdated" – they must be dated on the day in which they were written.

A practitioner may be able to certify that a period of illness occurred before the date of consultation and are advised to give careful consideration before issuing a certificate that includes days prior to the examination date.

Whether or not you're bulk-billed or paying a gap to see a GP may be a moot point. Especially in rural and remote areas, where declining workforces and population increases have made it increasingly difficult to see a GP at short notice.

Consult your pharmacist

Pharmacists are able to issue medical certificates for a range of ailments that may require an absence from work.

"It could be a migraine or severe headache, it could be temporary diarrhea … cold and flu," Pharmacy Guild of Australia national vice president Anthony Tassone explains.

"Infections [where] they're not well enough to work but it should resolve soon," Mr Tassone, who also practices at a pharmacy he co-owns in Victoria, says.

Mr Tassone says "it's a matter for the pharmacy what they charge their patients, should they offer that service".

"My pharmacy charges a fee of $25 and that is for a one-on-one consultation with the patient, or carer, if someone's seeking carer's leave.

"That's conducted in a private consultation room and notes are taken about the history of the patient and the presenting complaint and then, should a certificate be suitable, one is produced and recorded and provided to the patient."

Opting for online

Telehealth services and apps have been available for several years and have gained more prominence since the pandemic.

One provider offers certificates from as little as $9.

Another, which charges $19 for single-day absences, claims that an Australian Health Practitioner Regulation Agency-accredited doctor or nurse practitioner will review requests "within 15 minutes, 24/7", after patients fill out a short questionnaire, and approved certificates will then be issued via email.

Many of these services also issue medical certificates for up to seven days' medical leave for less than $50 after a telehealth consultation.

Submitting a statutory declaration

According to the Fair Work Ombudsman, a statutory declaration is an example of "an acceptable form of evidence" for medical leave.

The ombudsman states that "while there are no strict rules on what type of evidence needs to be given, the evidence has to convince a reasonable person that the employee was genuinely entitled to the sick or carer's leave".

Writing a statutory declaration in lieu of a medical certificate might sound like an easy option, but there's more to the process than simply drafting an email that declares you were unfit for work.

The declaration must be approved by either a Justice of the Peace (JP), Commissioner for Declarations or a lawyer and although a JP cannot charge a fee for their services, an employer may still question whether it constitutes reasonable evidence.

False information or documentation

Professor McCrystal, also warns providing any potentially false or misleading information to your employer could have serious consequences.

"If you go down the stat dec line, that's a legal document," she says.

"You never want to be telling untruths to your employer, but [doing so] in that very formal way could very much be grounds for a future disciplinary matter."

WASHINGTON — During the busiest time of the tax filing season, the Internal Revenue Service kicked off its 2024 Tax Time Guide series to help remind taxpayers of key items they’ll need to file a 2023 tax return.

As part of its four-part, weekly Tax Time Guide series, the IRS continues to provide new and updated resources to help taxpayers file an accurate tax return. Taxpayers can count on IRS.gov for updated resources and tools along with a special free help page available around the clock. Taxpayers are also encouraged to read Publication 17, Your Federal Income Tax (For Individuals) for additional guidance.

Essentials to filing an accurate tax return

The deadline this tax season for filing Form 1040, U.S. Individual Income Tax Return , or 1040-SR, U.S. Tax Return for Seniors , is April 15, 2024. However, those who live in Maine or Massachusetts will have until April 17, 2024, to file due to official holidays observed in those states.

Taxpayers are advised to wait until they receive all their proper tax documents before filing their tax returns. Filing without all the necessary documents could lead to mistakes and potential delays.

It’s important for taxpayers to carefully review their documents for any inaccuracies or missing information. If any issues are found, taxpayers should contact the payer immediately to request a correction or confirm that the payer has their current mailing or email address on file.

Creating an IRS Online Account can provide taxpayers with secure access to information about their federal tax account, including payment history, tax records and other important information.

Having organized tax records can make the process of preparing a complete and accurate tax return easier and may also help taxpayers identify any overlooked deductions or credits .

Taxpayers who have an Individual Taxpayer Identification Number or ITIN may need to renew it if it has expired and is required for a U.S. federal tax return. If an expiring or expired ITIN is not renewed, the IRS can still accept the tax return, but it may result in processing delays or delays in credits owed.

Changes to credits and deductions for tax year 2023

Standard deduction amount increased. For 2023, the standard deduction amount has been increased for all filers. The amounts are:

  • Single or married filing separately — $13,850.
  • Head of household — $20,800.
  • Married filing jointly or qualifying surviving spouse — $27,700.

Additional child tax credit amount increased. The maximum additional child tax credit amount has increased to $1,600 for each qualifying child.

Child tax credit enhancements. Many changes to the Child tax credit (CTC) that had been implemented by the American Rescue Plan Act of 2021 have expired.

However, the IRS continues to closely monitor legislation being considered by Congress affecting the Child Tax Credit. The IRS reminds taxpayers eligible for the Child Tax Credit that they should not wait to file their 2023 tax return this filing season. If Congress changes the CTC guidelines, the IRS will automatically make adjustments for those who have already filed so no additional action will be needed by those eligible taxpayers.

Under current law, for tax year 2023, the following currently apply:

  • The enhanced credit allowed for qualifying children under age 6 and children under age 18 has expired. For 2023, the initial amount of the CTC is $2,000 for each qualifying child. The credit amount begins to phase out where AGI income exceeds $200,000 ($400,000 in the case of a joint return). The amount of the CTC that can be claimed as a refundable credit is limited as it was in 2020 except that the maximum ACTC amount for each qualifying child increased to $1,500.
  • The increased age allowance for a qualifying child has expired. A child must be under age 17 at the end of 2023 to be a qualifying child.

Changes to the Earned Income Tax Credit (EITC). The enhancements for taxpayers without a qualifying child implemented by the American Rescue Plan Act of 2021 will not apply for tax year 2023. To claim the EITC without a qualifying child in 2023, taxpayers must be at least age 25 but under age 65 at the end of 2023. If a taxpayer is married filing a joint return, one spouse must be at least age 25 but under age 65 at the end of 2023.

Taxpayers may find more information on Child tax credits in the Instructions for Schedule 8812 (Form 1040) .

New Clean Vehicle Credit. The credit for new qualified plug-in electric drive motor vehicles has changed. This credit is now known as the Clean Vehicle Credit. The maximum amount of the credit and some of the requirements to claim the credit have changed. The credit is reported on Form 8936, Qualified Plug-In Electric Drive Motor Vehicle Credit , and on Form 1040, Schedule 3.

1099-K reporting requirements have not changed for tax year 2023

Following feedback from taxpayers, tax professionals and payment processors, and to reduce taxpayer confusion, the IRS recently released Notice 2023-74 announcing a delay of the new $600 reporting threshold for tax year 2023 on Form 1099-K, Payment Card and Third-Party Network Transactions . The previous reporting thresholds will remain in place for 2023.

The IRS has published a fact sheet with further information to assist taxpayers concerning changes to 1099-K reporting requirements for tax year 2023.

Form 1099-K reporting requirements

Taxpayers who take direct payment by credit, debit or gift cards for selling goods or providing services by customers or clients should get a Form 1099-K from their payment processor or payment settlement entity no matter how many payments they got or how much they were for.

If they used a payment app or online marketplace and received over $20,000 from over 200 transactions,

the payment app or online marketplace is required to send a Form 1099-K. However, they can send a Form 1099-K with lower amounts. Whether or not the taxpayer receives a Form 1099-K, they must still report any income on their tax return.

What’s taxable? It’s the profit from these activities that’s taxable income. The Form 1099-K shows the gross or total amount of payments received. Taxpayers can use it and other records to figure out the actual taxes they owe on any profits. Remember that all income, no matter the amount, is taxable unless the tax law says it isn’t – even if taxpayers don’t get a Form 1099-K.

What’s not taxable? Taxpayers shouldn’t receive a Form 1099-K for personal payments, including money received as a gift and for repayment of shared expenses. That money isn’t taxable. To prevent getting an inaccurate Form 1099-K, note those payments as “personal,” if possible.

Good recordkeeping is key. Be sure to keep good records because it helps when it’s time to file a tax return. It’s a good idea to keep business and personal transactions separate to make it easier to figure out what a taxpayer owes.

Direct File pilot program provides a new option this year for some

The IRS launched the Direct File pilot program during the 2024 tax season. The pilot will give eligible taxpayers an option to prepare and electronically file their 2023 tax returns, for free, directly with the IRS.

The Direct File pilot program will be offered to eligible taxpayers in 12 pilot states who have relatively simple tax returns reporting only certain types of income and claiming limited credits and deductions. The 12 states currently participating in the Direct File pilot program are Arizona, California, Florida, Massachusetts, Nevada, New Hampshire, New York, South Dakota, Tennessee, Texas, Washington state and Wyoming. Taxpayers can check their eligibility at directfile.irs.gov .

The Direct File pilot is currently in the internal testing phase and will be more widely available in mid-March. Taxpayers can get the latest news about the pilot at Direct File pilot news and sign up to be notified when Direct File is open to new users.

Glitches with new FAFSA form leave prospective college students in limbo

High school senior Jailyn James of New Jersey is a three-sport athlete with good grades and six college acceptance letters.

James will be the first in her family to attend college. But where she ends up depends on the amount of financial aid she receives from each school — offers she should already have.

"My mom will not let me commit without knowing my financial aid," James said. "I don't want to come out of college with a bunch of debt."

The delays are due to the U.S. Department of Education's overhaul of the Free Application for Federal Student Aid , known as FAFSA. The form is now shorter and simpler, but computer glitches have led to a botched rollout.

Typically, FAFSA forms are released on Oct. 1. Once submitted, the data is sent to colleges within one to three days, and it is then used to calculate financial aid.

But the updated application forms came out three months late, on Dec. 30, 2023. And schools will not receive the data until the first half of March.  

The delay has forced some colleges to push their financial aid deadlines. Last week, the Pennsylvania State System of Higher Education announced that its 10 state universities will extend the student commitment deadline to May 15.

"Some universities are pushing, certainly, their priority deadlines for grants," said Rachel Burns, senior policy analyst for the State Higher Education Executive Officers Association. "State agencies are doing the same thing. We don't know yet whether institutions are going to be able to change their decision deadlines."

For James, pressure is mounting. Most of the schools she has applied to require a deposit by May 1.

"My biggest worry, I would say, is that there's not enough time," said her mother, Lori James, who added that her daughter would have already chosen her college if not for the FAFSA processing delay.

However, as it is, students like James can only hope the FAFSA fumble doesn't delay their college dreams.
