Ftc releases fiscal year 2023 annual report, ftc sends refunds to consumers harmed by false made in usa claims by cycra, simple health plans llc.

On Oct. 29, 2018, the Federal Trade Commission filed a complaint in federal court against Simple Health Plans LLC, Steven J. Dorfman, and five other entities, alleging that the defendants misled people to think they were buying comprehensive health insurance that would cover preexisting medical conditions, prescription drugs, primary and specialty care treatment, inpatient and emergency hospital care, surgical procedures, and medical and laboratory testing. On Nov. 1, 2019, the FTC filed an amended complaint adding Candida Girouard as an additional defendant.  

H&R Block, In the Matter of

The Federal Trade Commission is taking action against tax preparation company H&R Block for unfairly deleting consumers’ tax data and requiring them to contact customer service when they downgrade to more affordable online products, and deceptively marketing their products as “free” when they were not free for many consumers. These practices cost consumers time and money.

BetterHelp Customers Will Begin Receiving Notices About Refunds Related to a 2023 Privacy Settlement with FTC

The sellers of a supposed N95-grade face mask called the Zephyr will pay more than $1.1 million to provide full refunds to consumers nationwide, as well as a civil penalty, under a proposed settlement the Federal Trade Commission announced today. The order settling the complaint also bars Razer, Inc., from making COVID-related health misrepresentations or unsubstantiated health claims about protective health equipment and requires them to pay a civil penalty of $100,000. 

FTC Action Leads to $43.6 Million in Financial Relief from Water Treatment Financing Company Aqua Finance

The Federal Trade Commission is taking action   against payment processing company BlueSnap, Inc., along with its former CEO Ralph Dangelmaier and senior vice president Terry Monteith, charging them with knowingly processing payments for deceptive and fraudulent companies. The defendants have agreed to a settlement that will require them to turn over $10 million for consumers and stop processing payments for certain high-risk clients.

In a federal court complaint, the FTC charged that BlueSnap and its officers processed millions of dollars in credit card payments for ACRO Services despite substantial evidence that the company was fraudulent. The FTC sued ACRO Services in November 2022.

FTC Takes Action Against BlueSnap and its Former CEO and Senior VP for Credit Card Laundering, Processing Payments for Known Scammer

A Federal Trade Commission action against household water treatment funding company Aqua Finance, Inc. (AFI) has led to a settlement   that will provide $20 million in refunds and an additional $23.6 million in debt forgiveness for consumers harmed by its dealers’ deceptive sales tactics.

The FTC’s complaint   against AFI charges that the company’s nationwide network of dealers went door-to-door, deceiving consumers about the financing terms for water filtering and softening products. According to the complaint, the bogus claims left consumers with thousands of dollars in unexpected debt and huge interest payments, while its financing terms impaired some consumers’ ability to sell their homes. 

FTC Finalizes Order with InMarket Prohibiting It from Selling or Sharing Precise Location Data

Ftc, doj, and hhs extend comment period on cross-government inquiry on impact of corporate greed in health care, inmarket media, llc.

InMarket Media will be prohibited from selling or licensing any precise location data to settle Federal Trade Commission charges that the company did not fully inform consumers and obtain their consent before collecting and using their location data for advertising and marketing.

Consumer courts were set up in India to promote and protect the rights of consumers who were cheated on the purchase of goods or services. If you were injured or lost money as the result of a defective product or service, or if a seller promised something they never delivered, you can file a complaint in consumer court and recover your losses. To successfully file a case in consumer court, you must be able to prove that the seller violated consumer protection laws and is responsible for your loss. [1] X Research source

Gathering Information and Documentation

Step 1 Collect receipts and other evidence of the transaction.

  • If the seller's name and address aren't available on your receipt, you may be able to find it online or in your bank records.
  • The date of the transaction is the date on the receipt (if you have one), not the date the transaction cleared your bank account (which may be a few days later). If you don't have a receipt, you can still use the date the transaction cleared your bank account as the reference date. The seller may have additional records of the transaction.

Tip: Generally, your complaint must be filed within 2 years of the date of the transaction. However, you may be able to file a complaint about an older transaction if you can prove to the court that there was a good reason for your delay.

Step 2 Gather additional documents to support your claim.

  • For example, if you're claiming you were injured by a defective product, medical records showing that you sought treatment for an injury caused by the product would provide evidence for your claim.
  • Also include any communications between you and the seller following the transaction. If you talked to the seller over the phone, create a log of all the information you recorded or remember about those conversations, including the date and time they took place and the name of the person you spoke with.

Step 3 Decide what type of relief you want from the consumer court.

  • You must be prepared to prove you are entitled to the relief you seek. For example, if you want the company to compensate you for expenses you incurred because you were injured by a defective product, you would need to bring documents showing medical expenses, loss of work, and other costs.

Step 4 Discuss your complaint with a lawyer.

  • Some lawyers will also help you fill out the initial paperwork without representing you in court. If you're confident with your own presentation skills, this can save you some money.

Tip: You can file a complaint in a consumer court without hiring a lawyer or going through a consumer organization.

Step 5 Factor in fees and travel costs.

  • To determine your traveling costs, figure out the court where you need to file your complaint. District forums are located in every district and hear complaints of up to Rs. 20 lakh. State commissions hear complaints between Rs. 20 lakh and Rs. 1 crore. The National Consumer Disputes Redressal Commission (NCDRC) hears complaints that exceed Rs. 1 crore.   • There are no court fees for claims up to Rs. 1 lakh if you are below the poverty line and have an Antyodaya Anna Yojana card. Others pay Rs. 100 for claims up to Rs. 1 lakh. The fee is Rs. 200 for claims from Rs. 1 lakh to Rs. 5 lakh, Rs. 400 for claims from Rs. 5 lakh to Rs. 10 lakh, and Rs. 500 for claims from Rs. 10 lakh to Rs. 20 lakh. State Commission claims are from Rs. 2,000 to Rs. 4,000 depending on the amount of your claim. NCDRC claims are Rs. 5,000.
  • Keep in mind that even if you hire a lawyer, you'll still have to put forth considerable time and effort on your case in addition to paying your lawyer's fee. Your lawyer won't be doing all the work for you and you may still have to attend court hearings.

Filing Your Complaint

Step 1 Send a legal notice to the registered office of the company.

  • You can search online for forms you can use that include all the information you need to notify the company of your claim. Make sure you adapt any form you use to address your specific issue.
  • Make copies of any receipts or other documents that support your claim to send along with your letter.
  • Make a copy of your letter before you send it. Use registered mail so you know when the company received it. You can use this date to mark the date of your deadline on your calendar.

Tip: If the company refuses your letter or fails to respond within the time you provided, you can go ahead and file your complaint with the consumer court.

Step 2 Draft your complaint.

  • Attach copies of documents that support all factual statements you make in your complaint, including receipts, bills, or transaction statements.
  • You may be able to find forms or samples of complaints online that you can use as a guide to format your complaint. Samples may also be available at your district consumer forum, or in the office of a local consumer organization.

Step 3 Prepare a demand draft for your court fees.

  • Rs. 100 for complaints of up to Rs. 1 lakh (District Forum)
  • Rs. 200 for complaints above Rs. 1 lakh and up to Rs. 5 lakh (District Forum)
  • Rs. 400 for complaints above Rs. 5 lakh and up to Rs. 10 lakh (District Forum)
  • Rs. 500 for complaints above Rs. 10 lakh and up to Rs. 20 lakh (District Forum)
  • Rs. 2,000 for complaints above Rs. 20 lakh and up to Rs. 50 lakh (State Commission)
  • Rs. 4,000 for complaints above Rs. 50 lakh and up to Rs. 1 crore (State Commission)
  • Rs. 5,000 for complaints above Rs. 1 crore (National Commission)

Step 4 Submit your complaint to the appropriate court.

Tip: If you mail your complaint to the appropriate court, rather than taking it to the clerk in person, your signature must be notarized.

Resolving Your Case

Step 1 Attend your admissions hearing.

  • If your case is admitted, the judge will let you know when your next hearing is. The second hearing typically will be more than 30 days after your admissions hearing.
  • If the court decides not to admit your case, the judge will give you information on how to appeal that decision.

Step 2 Present your case at your second hearing.

  • If the seller provides a written response to your complaint, read over it and come up with responses as necessary. You will be expected to refute their arguments in court.
  • Bring copies and originals of all the supporting documents you also included with your complaint.

Tip: Even if the seller does not appear in court for the hearing, you still must prove that you're entitled to the relief you've asked for before the judge will rule in your favor.

Step 3 Appear at any other hearings as required by the court.

  • For example, if you were injured because of a defected product, the judge may want to wait until your injuries are completely healed before ordering relief.

Tip: If you don't show up for hearings, your case will simply be decided on the merits, based on whatever written information and supporting documents have been filed.

Step 4 Receive the court's written order by registered post.

  • It's a good idea to make several photocopies of the order for your personal records.

Step 5 File an appeal within 30 days of receipt of an order.

  • If the court doesn't decide in your favor, instructions for filing an appeal will be included along with your copy of the written order. It is recommended that you file your appeal as soon as possible, rather than waiting to the last minute.
  • If you decide to appeal the consumer court's order, it's a good idea to talk to a consumer attorney near you. If the consumer court ruled against you because of an error you made in your complaint, you want to make sure you don't make the same mistake twice.

Supreme Court rebuffs challenge to consumer protection agency

WASHINGTON — The Supreme Court on Thursday rejected a business-backed challenge that could have scuttled the federal agency set up to protect consumers from shady financial services practices.

The court in a 7-2 vote ruled that the funding structure of the Consumer Financial Protection Bureau (CFPB), which allows the agency to be funded directly by the Federal Reserve, is constitutionally sound.

In doing so, the court rejected claims brought by two trade groups representing lenders, which argued that the agency had to be funded by annual appropriations approved by Congress.

President Joe Biden hailed the ruling, saying in a statement that it marked "an unmistakeable win for American consumers."

Sen. Elizabeth Warren, D-Mass., who proposed that the bureau be created and helped set it up, welcomed the decision in a celebratory appearance outside the Supreme Court building.

"This news is fabulous," she said. "When you have an agency that is this good at doing its job to protect consumers, then a lot of banks, a lot of payday lenders, a lot of Republicans, come after it and try to shut it down."

Conservative Justice Clarence Thomas authored the majority opinion, while fellow conservatives Justice Samuel Alito and Justice Neil Gorsuch dissented.

The court ruled that the funding structure, in which Congress does not directly appropriate funding, does not run afoul of the Constitution’s appropriations clause, which requires that “no money shall be drawn from the Treasury” without congressional approval.

“Although there may be other constitutional checks on Congress’ authority to create and fund an administrative agency, specifying the source and purpose is all the control the Appropriations Clause requires,” Thomas wrote.

The case is one of several on the docket in which the Supreme Court, often skeptical of broad federal agency power, could  hobble government regulators . On this occasion, the court, which has a 6-3 conservative majority, held fire.

In dissent, Alito said the court had affirmed a novel funding structure that allows the agency to “bankroll its own agenda without any congressional control or oversight.”

More broadly, the ruling means that “there is apparently nothing wrong” with laws that allow executive branch agencies to be funded independently and with no expiration date, he added.

In 2018, the Community Financial Services Association of America and the Consumer Service Alliance of Texas sued the CFPB in an effort to throw out a regulation cracking down on payday loans.

A federal judge ruled in favor of the bureau after it modified a regulation barring lenders from repeatedly seeking to withdraw loan repayments from consumers’ bank accounts if there are insufficient funds. The new rule has yet to take effect.

But the legal question before the Supreme Court rested on a subsequent decision by the New Orleans-based 5th U.S. Circuit Court of Appeals, which ruled in October 2022 that the bureau’s funding mechanism was unlawful.

That ruling by what is one of the most conservative appeals courts in the nation was an outlier that even the conservative-majority Supreme Court viewed as a step too far.

Chris Vergonis, a lawyer for the challengers, said the underlying regulation at issue is “legally flawed” and harms consumers who rely on short-term loans.

Beth Milito, executive director of the National Federation for Independent Business, a group representing small business-owners that backed the legal challenge, said the failure to weaken the agency “will ultimately leave small businesses with expensive penalties and burdensome inspections at the hands of the CFPB.”

Consumer advocates and financial services industry critics expressed relief about Thursday’s ruling.

“This decision removes a major threat to the agency’s work and reaffirms the independence that allows it to continue standing up for the public interest against abusive financial practices,” said Lisa Donner, executive director of Americans for Financial Reform Education Fund.

Congress itself set up the CFPB and approved the current funding structure when it passed the Dodd-Frank Wall Street Reform and Consumer Protection Act in 2010.

The law states that the CFPB receives funding determined by its director to be “reasonably necessary to carry out the authorities of the bureau” as long as it is under the cap of 12% of the operating expenses of the Federal Reserve. In the 2022 fiscal year, the agency received $641 million.

The Biden administration argued that Congress “enacted a statute specifically organizing the CFPB to use a specified amount of funds from a specified source for a specified purpose,” which was sufficient to pass constitutional muster.

The CFPB has faced various legal challenges in the past, with the Supreme Court ruling in 2020 that a separate provision that protected its single director from removal by the president at any time during the five-year term of office was unconstitutional.

The Case Monitoring System provides a single-window solution for automation of all the activities undertaken at the Consumer Commissions at the National, State and District Levels. The registration of complaints, recording of court proceedings, issue of notices, generation of cause lists, recording of judgments, record-keeping and generation of statistical reports and all other court related activities are carried out through this standardized software alone. Role-based logins can be created for the different users and related services can be easily offered to them.

The various services provided by the Case Monitoring System have been diagrammatically depicted below:

The Case Monitoring System has automated the tasks of Consumer Commissions by providing the following facilities:

  • Cause list is generated automatically
  • Case status is readily available
  • Quick view of the case history
  • Quick search facility using case number, complainant name, respondent name etc
  • Judgment search using free text search
  • Automatic notice generation after one time master entry
  • Various statistical reports generation

The Case Monitoring System incorporates specifically designed modules which allow replication of data to a Centralized Online Server. Once data has been exported to this server, it can be accessed by the general public in the form of case status and case history information, cause lists, judgments and national level reports.

Supreme Court upholds Consumer Financial Protection Bureau in major win for Biden, Democrats

Payday loan companies had alleged the way CFPB is funded was unconstitutional.

The Supreme Court on Thursday upheld the Consumer Financial Protection Bureau and how Congress decided to fund the agency, rejecting a constitutional challenge by the banking industry and preserving a broad set of regulations that govern everything from credit cards to personal loans and home mortgages.

The court's decision , a 7-2 ruling with Justices Samuel Alito and Neil Gorsuch dissenting, is a major victory for the Biden administration and Democrats who have championed the independent agency as a bulwark against corporate financial abuses after the 2008 crash.

Conservatives have spent years attacking the CFPB as a source of undue and costly government regulation. This case centered on a group of payday lenders that alleged the indirect funding of the CFPB through the Federal Reserve System rather than annual congressional appropriations violated the Constitution's Appropriations Clause, which says no taxpayer funds should be spent without "appropriations made by law."

Justice Clarence Thomas, who wrote the opinion, said while the associations made several arguments for why the agency's funding mechanism was constitutionally unsound, "none is persuasive."

"Under the Appropriations Clause, an appropriation is simply a law that authorizes expenditures from a specified source of public money for designated purposes," Thomas wrote. "The statute that provides the Bureau's funding meets these requirements. We therefore conclude that the Bureau's funding mechanism does not violate the Appropriations Clause."

In a statement to ABC News, a CFPB spokesperson called the Supreme Court's decision "a resounding victory for American families and honest businesses alike."

"For years, lawbreaking companies and Wall Street lobbyists have been scheming to defund essential consumer protection enforcement," the spokesperson said. "The Supreme Court has rejected their radical theory that would have devastated the American financial markets. The Court repudiated the arguments of the payday loan lobby and made it clear that the CFPB is here to stay."

Justice Alito, in a dissent joined by Gorsuch, blasted the majority's interpretation as creating a loophole that would allow Congress to create agencies that "spend public funds in perpetuity" without direct oversight by Congress.

"The Framers would be shocked, even horrified, by this scheme," Alito wrote.

"In sum, centuries of historical practice show that the Appropriations Clause demands legislative control over the source and disposition of the money used to finance Government operations and projects," he wrote.

Google on Thursday asked that a judge, rather than a jury, decide whether it violated U.S. antitrust laws by building a monopoly on the technology that powers online advertising.

To bolster its case, the tech giant wrote a multimillion-dollar check to the U.S. government that it says renders moot the government's best argument for demanding a jury trial.

The antitrust case set to go before a jury in Alexandria, Virginia , in September is one of two major lawsuits the Justice Department has brought against Google. While the Virginia case focuses on advertising technology, an ongoing case in the District of Columbia focuses on Google's dominance as a search engine.

Both sides in the D.C. case have presented evidence and made closing arguments . A judge there will decide whether Google violated the law.

Google wants a judge to decide the merits of the case in Virginia, as well. The company argues in court papers filed Thursday that it's unprecedented for a jury to decide a federal antitrust case brought by the government. It says that this case in particular involves "a complicated, intricate technology ecosystem, which DOJ has acknowledged to this Court is ‘highly technical, often abstract, and outside the everyday knowledge of most prospective jurors.’”

A Department of Justice spokesperson did not immediately respond to an email seeking comment Thursday evening.

Google, based in Mountain View, California , makes two primary arguments for striking the government's demand for a jury trial. For starters, Google argues that the constitutional right to a jury trial does not apply to a civil suit brought by the government.

The right to a jury trial, based in the Bill of Rights, “protects citizens against the federal government, not the other way around,” Google's lawyers write in their court filing.

The company acknowledges in the court papers, though, that the Justice Department has a stronger argument for demanding a jury in a case where it seeks monetary damages, as opposed to merely seeking equitable relief, like forcing Google to sell off parts of its advertising technology.

In the Virginia case, the Department of Justice seeks monetary damages on behalf of federal agencies, including the Army, that it says were harmed by Google's monopolistic practices and overpaid for online ads that they purchased.

In its court filing, Google contends that the damage claim was tacked on to the lawsuit at the last minute for the sole purpose of allowing them to seek a jury.

The Department of Justice “manufactured a damages claim at the last minute in an attempt to secure a jury trial in a case even they describe as ‘highly technical’ and ‘outside the everyday knowledge of most prospective jurors,” the company said in a written statement Thursday.

Google's filing Thursday said the company has cut a check to the government that is triple the amount of the losses the government can claim. The exact amount of the check is redacted, but in other court papers, Google said the maximum amount of damages the government was able to demonstrate during the discovery process was less than $1 million.

Because the law allows antitrust damages to be trebled, the check amount would be less than $3 million.

Google says it still disputes that the damages are legitimate, but says that paying the government's claimed damages eliminates the need for a jury to decide the damages question.

While Google says it's unprecedented for a jury to decide a government antitrust suit, Google has defended itself in front of a jury on antitrust cases brought by private companies.

Last year, a jury in San Francisco ruled in favor of Epic Games , the maker of the popular Fortnite game, in a case the company brought against Google over the Google Play store, which allows users of Android phones to download apps.

In that case, Google tried unsuccessfully at the last minute to switch the trial from a jury trial to a bench trial.
