GOP advances Garland contempt charges after White House exerts executive privilege over Biden audio

The White House has blocked the release of audio from President Joe Biden’s interview with a special counsel about his handling of classified documents, arguing Thursday that Republicans in Congress only wanted the recordings “to chop them up” and use them for political purposes.

WASHINGTON (AP) — Two House committees moved ahead Thursday with contempt charges against Attorney General Merrick Garland for refusing to turn over audio from President Joe Biden’s interview with a special counsel , advancing the matter after the White House’s decision to block the release of the recording earlier in the day.

In back-to-back hearings that nearly spilled into early Friday, the House Judiciary and Oversight and Accountability committees voted along party lines to advance an effort to hold Garland in contempt of Congress for not turning over the records. But the timing of any action by the full House, and the willingness of the U.S. attorney’s office to act on the referral, remained uncertain.

“The department has a legal obligation to turn over the requested materials pursuant to the subpoena,” Rep. Jim Jordan, the GOP chairman of the Judiciary Committee, said during the hearing. “Attorney General Garland’s willful refusal to comply with our subpoena constitutes contempt of Congress.”

The rapid sequence of events Thursday further inflamed tensions between House Republicans and the Justice Department, setting the stage for another round of bitter fighting between the two branches of government that seemed nearly certain to spill over into court.

If House Republicans’ efforts against Garland are successful, he will become the third attorney general to be held in contempt of Congress. The White House slammed Republicans in a letter earlier Thursday, dismissing their efforts to obtain the audio as purely political.

“The absence of a legitimate need for the audio recordings lays bare your likely goal — to chop them up, distort them, and use them for partisan political purposes,” White House counsel Ed Siskel wrote in a scathing letter to House Republicans ahead of scheduled votes by the two House committees to refer Garland to the Justice Department for the contempt charges.

“Demanding such sensitive and constitutionally-protected law enforcement materials from the Executive Branch because you want to manipulate them for potential political gain is inappropriate,” Siskel added.

Garland separately advised Biden in a letter made public Thursday that the audio falls within the scope of executive privilege, which protects a president’s ability to obtain candid counsel from his advisers without fear of immediate public disclosure and to protect confidential communications relating to official responsibilities.

The attorney general told reporters that the Justice Department has gone to extraordinary lengths to provide information to the committees about special counsel Robert Hur’s investigation, including a transcript of Biden’s interview with Hur. But, Garland said, releasing the audio could jeopardize future sensitive and high-profile investigations. Officials have suggested handing over the tape could make future witnesses concerned about cooperating with investigators.

Speaking with reporters, Attorney General Merrick Garland says the audio from President Biden’s special counsel interview that Republicans have requested will not be released.

“There have been a series of unprecedented and frankly unfounded attacks on the Justice Department,” Garland said. “This request, this effort to use contempt as a method of obtaining our sensitive law enforcement files is just most recent.”

The Justice Department warned Congress that a contempt effort would create “unnecessary and unwarranted conflict,” with Assistant Attorney General Carlos Uriarte saying, “It is the longstanding position of the executive branch held by administrations of both parties that an official who asserts the president’s claim of executive privilege cannot be held in contempt of Congress.”

Siskel’s letter to lawmakers comes after the uproar from Biden’s aides and allies over Hur’s comments about Biden’s age and mental acuity, and it highlights concerns in a difficult election year over how potentially embarrassing moments from the lengthy interview could be exacerbated by the release, or selective release, of the audio.

Republican House Speaker Mike Johnson slammed the White House’s move, accusing Biden of suppressing the tape because he’s afraid to have voters hear it during an election year.

“The American people will not be able to hear why prosecutors felt the President of the United States was, in Special Counsel Robert Hur’s own words, an ‘elderly man with a poor memory,’ and thus shouldn’t be charged,” Johnson said the during a press conference on the House steps.

House Democrats defended Biden’s rationale during the back-to-back hearings on Thursday, citing the massive trove of documents and witnesses who have been made available to Republicans as part of their more than yearlong probe into Biden and his family.

Rep. Jerry Nadler, the top Democrat on the Judiciary Committee, said on Thursday that Republicans want to make it seem like they’ve uncovered wrongdoing by the Justice Department.

“In reality, the Attorney General and DOJ have been fully responsive to this committee in every way that might be material to their long dead impeachment inquiry,” the New York lawmaker said. “Sometimes, they have been too responsive, in my opinion, given the obvious bad faith of the MAGA majority.”

The contempt effort is seen by Democrats as a last-ditch effort to keep Republicans’ impeachment inquiry into Biden alive, despite a series of setbacks in recent months and flailing support for articles of impeachment within the GOP conference.

A transcript of the Hur interview showed Biden struggling to recall some dates and occasionally confusing some details — something longtime aides say he’s done for years in both public and private — but otherwise showing deep recall in other areas. Biden and his aides are particularly sensitive to questions about his age. At 81, he’s the oldest-ever president , and he’s seeking another four-year term.

At a news conference, House Speaker Mike Johnson says the American people will not get to hear the president’s special counsel interview.

Hur, a former senior official in the Trump administration Justice Department , was appointed as a special counsel in January 2023 following the discovery of classified documents in multiple locations tied to Biden.

Hur’s report said many of the documents recovered at the Penn Biden Center in Washington, in parts of Biden’s Delaware home, and in his Senate papers at the University of Delaware were retained by “mistake.”

However, investigators did find evidence of willful retention and disclosure related to a subset of records found in Biden’s Wilmington, Delaware, house, including in a garage, an office and a basement den.

The files pertain to a troop surge in Afghanistan during the Obama administration that Biden had vigorously opposed. Biden kept records that documented his position, including a classified letter to Obama during the 2009 Thanksgiving holiday. Some of that information was shared with a ghostwriter with whom he published memoirs in 2007 and 2017.

President Biden has asserted executive privilege over the audio recordings of his interview with special counsel Robert Hur about Biden's handling of classified documents, according to the White House and the Justice Department.

The move comes as the Republican-led House Judiciary and Oversight committees are expected to advance a resolution to hold Attorney General Merrick Garland in contempt of Congress for refusing to provide the panels with the interview audio.

"Because of the President's longstanding commitment to protecting the integrity, effectiveness, and independence of the Department of Justice and its law enforcement investigations, he has decided to assert executive privilege over the recordings," Edward Siskel, counsel to the president, wrote in a letter to Rep. Jim Jordan, chairman of the House Judiciary Committee, and Rep. James Comer, chairman of the House Oversight Committee.

House Republicans are demanding the department turn over audio recordings of the interview special counsel Hur conducted with Biden in October 2023, about Biden's handling of classified documents after leaving the Obama administration. They also want the audio recording of Hur's interview with Biden's ghostwriter, Mark Zwonitzer.

In his report, Hur described Biden as "an elderly man with a poor memory," remarks that angered the White House and its Democratic allies. House Republicans have pressed their demands for the audio itself, saying the committees get to determine what materials they need for their investigation, not the White House.

Special counsel Hur defended Biden classified documents probe before Congress

At a hearing Thursday, Chairman Jordan of the Judiciary Committee asserted the recordings are necessary because "the transcripts alone are not sufficient evidence of the state of the president's memory."

The judiciary panel went on to vote along party lines to recommend Garland be held in contempt.

Chairman Comer, of the Oversight Committee, said in a written statement that the White House had already waived the privilege by giving lawmakers a transcript of the Biden interview.

"Today's Hail Mary from the White House changes nothing for our committee," Comer added. "The House Oversight Committee will move forward with its markup of a resolution and report recommending to the House of Representatives that Attorney General Garland be held in contempt of Congress for defying a lawful subpoena."

In his letter, Siskel noted disclosure of materials like the audio would make it less likely that witnesses in future high-profile investigations will voluntarily cooperate. And, he noted: "The absence of a legitimate need for the audio recordings lays bare your likely goal—to chop them up, distort them, and use them for partisan political purposes. Demanding such sensitive and constitutionally-protected law enforcement materials from the Executive Branch because you want to manipulate them for potential political gain is inappropriate."

Siskel added: "Rather than demonstrating respect for the rule of law, this contempt proceeding is just the latest in the Committees' damaging efforts to undermine the very independence and impartiality of the Department of Justice and criminal justice system that President Biden seeks to protect."

Interview transcript shows more nuance on Biden's memory than special counsel report

At the Justice Department Thursday morning, Attorney General Garland told reporters that DOJ had gone above and beyond the call of duty to provide information to the Republican-led House panels.

"We have gone to extraordinary lengths to ensure that the committees get responses to their legitimate requests but this is not one," Garland said. "To the contrary, this is one that would harm our ability in the future to successfully pursue sensitive investigations."

Earlier, Garland wrote in a letter to Biden that the "audio recordings of your interview ... fall within the scope of executive privilege." His letter also cited audio recordings as an important investigative tool in high-profile investigations.

The Justice Department already has provided Congress a transcript of the interview , helped facilitate Hur's testimony before the committees, handed over two classified documents requested by the panels and provided correspondence regarding the special counsel's inquiry.

"In short, the department has responded to each of the four requests in your subpoenas," Assistant Attorney General Carlos Felipe Uriarte said in a letter to the committees.

But he said the committees have failed to identified a need for the audio files of Biden's interview with Hur that would "serve the asserted purposes of your investigations."

He also pushed back on House Republicans' plan to hold Garland in contempt over the matter, saying "a contempt citation is not justified on this record."

"It is the longstanding position of the executive branch held by administrations of both parties that an official who asserts the President's claim of executive privilege cannot be prosecuted for criminal contempt of Congress," Uriarte said in his letter to the panels.

"Production of these recordings to the Committees would raise an unacceptable risk of undermining the Department's ability to conduct similar high-profile criminal investigations-in particular, investigations where the voluntary cooperation of White House officials is exceedingly important," he wrote.

Uriarte urged the committees to back away from their contempt votes, and noted that there is precedent for doing so. He said that in 2008, the House Oversight Committee withdrew a contempt vote after President George W. Bush asserted executive privilege over the record of a special counsel interview of the vice president, Dick Cheney, in an investigation that centered on the disclosure of the identity of a CIA official.

In his brief public remarks Thursday morning, the attorney general cast the House move as part of a broader, partisan campaign against the institution of the Justice Department. Garland alluded to remarks by House members trying to defund the office of special counsel Jack Smith, who has obtained two indictments of former President Donald Trump.

"There have been a series of unprecedented and frankly unfounded attacks on the Justice Department," Garland said. "This request, this effort to use contempt as a method of obtaining our sensitive law enforcement files is just the most recent. The effort to threaten to defund our investigations and the way in which there are contributions to an atmosphere that puts our agents and our prosecutors at risk, these are wrong."

Garland said he would continue to "protect this building and its people."

GOP Advances Garland Contempt Charges After White House Exerts Executive Privilege Over Biden Audio

Two House committees have moved ahead with contempt charges against Attorney General Merrick Garland for refusing to turn over audio from President Joe Biden’s interview with a special counsel

WASHINGTON (AP) — Two House committees moved ahead Thursday with contempt charges against Attorney General Merrick Garland for refusing to turn over audio from President Joe Biden’s interview with a special counsel , advancing the matter after the White House's decision to block the release of the recording earlier in the day.

In back-to-back hearings that nearly spilled into early Friday, the House Judiciary and Oversight and Accountability committees voted along party lines to advance an effort to hold Garland in contempt of Congress for not turning over the records. But the timing of any action by the full House, and the willingness of the U.S. attorney’s office to act on the referral, remained uncertain.

“The department has a legal obligation to turn over the requested materials pursuant to the subpoena,” Rep. Jim Jordan, the GOP chairman of the Judiciary Committee, said during the hearing. “Attorney General Garland’s willful refusal to comply with our subpoena constitutes contempt of Congress.”

The rapid sequence of events Thursday further inflamed tensions between House Republicans and the Justice Department, setting the stage for another round of bitter fighting between the two branches of government that seemed nearly certain to spill over into court.

If House Republicans’ efforts against Garland are successful, he will become the third attorney general to be held in contempt of Congress. The White House slammed Republicans in a letter earlier Thursday, dismissing their efforts to obtain the audio as purely political.

“The absence of a legitimate need for the audio recordings lays bare your likely goal — to chop them up, distort them, and use them for partisan political purposes," White House counsel Ed Siskel wrote in a scathing letter to House Republicans ahead of scheduled votes by the two House committees to refer Garland to the Justice Department for the contempt charges.

“Demanding such sensitive and constitutionally-protected law enforcement materials from the Executive Branch because you want to manipulate them for potential political gain is inappropriate,” Siskel added.

Garland separately advised Biden in a letter made public Thursday that the audio falls within the scope of executive privilege, which protects a president’s ability to obtain candid counsel from his advisers without fear of immediate public disclosure and to protect confidential communications relating to official responsibilities.

The attorney general told reporters that the Justice Department has gone to extraordinary lengths to provide information to the committees about special counsel Robert Hur's investigation, including a transcript of Biden's interview with Hur. But, Garland said, releasing the audio could jeopardize future sensitive and high-profile investigations. Officials have suggested handing over the tape could make future witnesses concerned about cooperating with investigators.

“There have been a series of unprecedented and frankly unfounded attacks on the Justice Department,” Garland said. “This request, this effort to use contempt as a method of obtaining our sensitive law enforcement files is just most recent.”

The Justice Department warned Congress that a contempt effort would create “unnecessary and unwarranted conflict," with Assistant Attorney General Carlos Uriarte saying, “It is the longstanding position of the executive branch held by administrations of both parties that an official who asserts the president's claim of executive privilege cannot be held in contempt of Congress."

Siskel’s letter to lawmakers comes after the uproar from Biden’s aides and allies over Hur’s comments about Biden’s age and mental acuity, and it highlights concerns in a difficult election year over how potentially embarrassing moments from the lengthy interview could be exacerbated by the release, or selective release, of the audio.

Republican House Speaker Mike Johnson slammed the White House’s move, accusing Biden of suppressing the tape because he's afraid to have voters hear it during an election year.

“The American people will not be able to hear why prosecutors felt the President of the United States was, in Special Counsel Robert Hur’s own words, an ‘elderly man with a poor memory,’ and thus shouldn’t be charged,” Johnson said the during a press conference on the House steps.

House Democrats defended Biden's rationale during the back-to-back hearings on Thursday, citing the massive trove of documents and witnesses who have been made available to Republicans as part of their more than yearlong probe into Biden and his family.

Rep. Jerry Nadler, the top Democrat on the Judiciary Committee, said on Thursday that Republicans want to make it seem like they’ve uncovered wrongdoing by the Justice Department.

“In reality, the Attorney General and DOJ have been fully responsive to this committee in every way that might be material to their long dead impeachment inquiry,” the New York lawmaker said. “Sometimes, they have been too responsive, in my opinion, given the obvious bad faith of the MAGA majority.”

The contempt effort is seen by Democrats as a last-ditch effort to keep Republicans' impeachment inquiry into Biden alive, despite a series of setbacks in recent months and flailing support for articles of impeachment within the GOP conference.

A transcript of the Hur interview showed Biden struggling to recall some dates and occasionally confusing some details — something longtime aides say he’s done for years in both public and private — but otherwise showing deep recall in other areas. Biden and his aides are particularly sensitive to questions about his age. At 81, he’s the oldest-ever president , and he's seeking another four-year term.

Hur, a former senior official in the Trump administration Justice Department , was appointed as a special counsel in January 2023 following the discovery of classified documents in multiple locations tied to Biden.

Hur’s report said many of the documents recovered at the Penn Biden Center in Washington, in parts of Biden’s Delaware home, and in his Senate papers at the University of Delaware were retained by “mistake.”

However, investigators did find evidence of willful retention and disclosure related to a subset of records found in Biden’s Wilmington, Delaware, house, including in a garage, an office and a basement den.

The files pertain to a troop surge in Afghanistan during the Obama administration that Biden had vigorously opposed. Biden kept records that documented his position, including a classified letter to Obama during the 2009 Thanksgiving holiday. Some of that information was shared with a ghostwriter with whom he published memoirs in 2007 and 2017.

Why Is Biden Trying to Hide the Special Counsel Recording?

P resident Joe Biden invoked executive privilege Thursday to keep House Republicans from obtaining audio recordings of his interview with special counsel Robert Hur.

The move came at the request of Attorney General Merrick Garland, who warned that cooperating with the request could jeopardize future investigations and witnesses’ willingness to participate in them. In his letter to Biden, made public Thursday, Garland said that lawmakers’ efforts “are plainly insufficient to outweigh the deleterious effects that the production of the recordings would have on the integrity and effectiveness of similar law enforcement investigations in the future.”

White House counsel Ed Siskel also questioned the motivations of Republicans seeking the tapes when they already possess a lengthy report and full transcript of the interview.

“The absence of a legitimate need for the audio recordings lays bare your likely goal—to chop them up, distort them, and use them for partisan political purposes,” Siskel wrote in a letter obtained by The Hill . “Demanding such sensitive and constitutionally-protected law enforcement materials from the Executive Branch because you want to manipulate them for potential political gain is inappropriate.”

Hur’s 388-page report condemned the 81-year-old president as having a memory with “significant limitations.” Republicans have since seized on the analysis, developed after a year-long investigation and a two-day interview with Biden days after Hamas’s October 7 attack in Israel, as an opportunity to attack the president as being mentally unfit for the job.

Democratic lawmakers joined the outrage at the request, including Maryland Representative Jamie Raskin, who called the effort to obtain the tapes—and Republicans’ failed impeachment effort of Biden—a “comedy of errors.”

“The Attorney General gave Republicans the information they asked for, and it’s delightfully absurd to suggest that listening to the President’s words instead of just reading them will suddenly reveal the mystery high crime and misdemeanor the Republicans have been unable to identify since 2023,” Raskin wrote in a statement shared with The New Republic. “Will this hopeless scavenger hunt ever end? Perhaps the Republicans should play the Beatles’ White Album backwards and the impeachable offense will emerge!”
